About Copyright & Legal Protection
How do you avoid copyright infringement?
Musikai generates original commercial music designed for business use. We do NOT recreate existing songs or artist styles. Our AI creates unique compositions optimized for jingles, background music, and commercial audio.
What if someone claims my music infringes their copyright?
Musikai generates original AI compositions that don't replicate existing songs. If you receive a claim, please contact us and we'll help you understand your options.
Is AI music copyrighted?
It depends on how much a human shapes the final track. The U.S. Copyright Office says a purely AI-generated song is not copyrighted on its own. Once a Musikai producer edits, arranges, and finalizes your track, that human work is what makes the song eligible for AI music copyright protection.
Can I publish a song written by AI?
Yes, you can publish a song written by AI, and Musikai tracks are cleared for exactly that. Just know that a purely AI-written song may not be legally protected the same way a human-written one is, which is why we always add a human producer's touch before delivery.
What is AI copyright, and how does it affect my music?
AI copyright is the set of rules that decide who, if anyone, owns something a computer helped create. Artificial intelligence and copyright law are still catching up to each other, so the safest approach is treating AI output as a first draft, not a final product, until a person has reviewed and refined it.
Where can I learn more about AI music copyright?
Read our blog post on whether AI music is copyrightable for a plain-language walkthrough of the U.S. Copyright Office's guidance, so you know exactly where your tracks stand.
About Licensing
Can I use Musikai music for client projects?
Client work requires a Pro or Studio plan. The Creator plan covers your own content, not work you produce for or deliver to a third-party client. Section 4.5 of the Terms sets out the exact scope of each plan.
Can I use this on YouTube, Instagram, or TikTok?
From the Creator plan up, yes, for your own monetized content on those platforms, as well as podcasts and releases under your own name on streaming services. The Free plan is limited to personal, non-monetized use. Paid advertising on those platforms requires Pro or Studio.
Can I use this in TV commercials or broadcasts?
Broadcast, film and TV sync, and paid advertising are covered on the Pro and Studio plans. The Creator plan does not include them.
Do I need to pay ASCAP or BMI fees?
Musikai does not collect performance royalties from you, and Self-Serve plans involve no revenue sharing, so you keep 100% of what your work earns within the scope of your plan. Performing-rights obligations attach to where music is publicly performed and vary by territory and venue, so if you are broadcasting or performing publicly, confirm what your broadcaster or venue requires. See Sections 4.4 and 5 of the Terms.
What happens to my licence if I cancel?
Your commercial use licence is tied to an active plan. When a paid plan ends, through cancellation, downgrade, or non-payment, that licence ends and you have 30 days to stop new commercial distribution and remove the output from commercial use. The licence is not perpetual; a perpetual or exclusive scope can be arranged as a separate paid upgrade.
General Questions
What is the difference between generating music myself and Musikai Production?
The Free, Creator, Pro, and Studio plans are self-serve: you generate the music, and you can refine it yourself in Musikai Studio. Musikai Production is a done-for-you engagement where our producers create the work for you, with scope, deliverables, revisions, and timeline agreed in your order.
What is Musikai Studio?
Studio is the production workspace for music you have already generated: work with stems, trim and rearrange sections, remix, and refine the arrangement before you export. The Studio plan also lets you send a track to a Musikai producer.
Can I cancel anytime?
Yes. Monthly plans are cancel-anytime, with no contracts or lock-ins. Note that your commercial use licence ends when the plan does, with a 30-day wind-down.
Do I own the rights to my music?
Not ownership, but a licence to use it. Because purely AI-generated material may not qualify for copyright protection, Musikai does not transfer ownership of AI-generated output; instead you get a licence whose scope depends on your plan. Work created for you under Musikai Production is different: it is made for hire and owned by Musikai, and you receive a full commercial use licence to it. Section 4 of the Terms covers this in detail.
What if I need more than my plan allows?
Every plan includes a monthly credit allotment, and each generation costs credits. If you run out, you can upgrade to a plan with a larger allotment. Unused credits do not roll over.
How long does a Musikai Production project take?
Scope, deliverables, revision rounds, and timeline are agreed in your order or written agreement before work starts, since they depend on what the project needs. Contact us and we will scope it with you.
